Terms of use

These terms apply to the use of the PounceFit app, provided by LEONARDO VINICIUS NERI CARACA CONSULTORIA EM TECNOLOGIA DA INFORMACAO LTDA, CNPJ 68.410.204/0001-34 ("we"). By installing or using the app, you agree to them.

1. What the app is

A desktop program that helps health and fitness professionals record measurements, calculate body composition indicators with formulas published in the scientific literature, and create reports.

2. The app does not diagnose

The results are estimates calculated from the measurements you type in or that the scale sends. They are not a medical diagnosis and do not replace the professional's assessment. Interpretation, guidance given to the client or patient, and treatment or training decisions are the sole responsibility of the professional using the app, within the rules of their professional board.

Scale bioimpedance varies with hydration, food intake, training and time of day, and may differ from other methods. Scales marked "in testing" have not been checked with the real device.

3. License

• You can use the app free for 14 days. After that, you need a paid license.
• The license is personal, non-exclusive and non-transferable, and is valid on up to 2 computers at the same time.
• The subscription renews each period (monthly or yearly) while payment is up to date. You can cancel at any time; access continues until the end of the paid period.
• If the license expires, the app keeps working for a grace period. After that, it enters read-only mode: you can open and view data, export PDFs, and create and restore backups, but you cannot add new clients or assessments.
• You may not copy, resell, modify or bypass the app's license system.

3.1 Founder and Courtesy plans

• On the Founder plan, the subscription price, monthly or yearly, stays frozen while the subscription is active without interruption. The number of spots is limited.
• If the Founder subscription is canceled, or if a payment is not settled within the 7-day grace period, the license is no longer renewed and the spot is released. To return to the Founder plan, a spot must be available, and the Founder price in effect at the time of the new subscription applies.
• The Courtesy license is free, granted at our discretion, and has no expiration date.
• On the Founder and Courtesy plans, "all features" means the features of the PounceFit app for the professional. Future services with cloud costs, such as a client app with sync, may have their own terms and prices. On the Founder plan, these services are charged at cost, with no profit margin.
• Access lasts as long as the product exists and, on the Founder plan, as long as the subscription is active.

4. Your data

The data you enter stays on your computer and belongs to you. You are the controller of your clients' and patients' data under the LGPD (Brazil's General Data Protection Law), as explained in the privacy policy. Making backups and keeping their password safe is your responsibility: without the password, not even we can open a backup.

5. Updates and support

While the license is active, you receive app updates. Support is provided by email at contato@pouncefit.com, on business days, with a reply within 2 business days.

6. Limitation of liability

The app is provided as is. We do our best to make the calculations follow the published formulas and to fix errors we find, but we do not guarantee that the app is free of faults. To the extent permitted by law, we are not liable for data loss caused by lack of backups, computer failure, misuse, or decisions made based on the results. Where we are liable, our liability is limited to the amount you paid us in the 12 months before the problem, except where the law does not allow such a limit.

7. Right of withdrawal and refunds

For online purchases, you can withdraw within 7 days of purchase for a full refund (Brazilian Consumer Defense Code, art. 49). After that period, you can cancel the subscription at any time: it will not renew, access continues until the end of the period already paid, and there is no prorated refund for that period.

8. Changes to these terms

We may change these terms. Significant changes are announced by email in advance.

9. Jurisdiction

The courts of the judicial district of São Paulo - SP, Brazil, are chosen to settle disputes, without prejudice to the courts of the consumer's place of residence.
