Privacy policy

This policy explains what data the PounceFit app and this website process, and who is responsible for it. The responsible company is LEONARDO VINICIUS NERI CARACA CONSULTORIA EM TECNOLOGIA DA INFORMACAO LTDA, CNPJ 68.410.204/0001-34 ("we").

1. Your clients' and patients' data

The app runs entirely on your computer. Names, dates of birth, measurements, photos, lab results, assessment results and any other data you enter are stored only on your computer and in the backups you make. We do not receive, see or store this data.

This data includes health data, which is sensitive personal data under Brazil's General Data Protection Law (LGPD, Law 13,709/2018, art. 11). Because you decide to collect it and how to use it, you are the controller of this data and are responsible for:

• having a legal basis for the processing, such as health protection by a health professional or the data subject's consent;
• informing your clients and patients about how their data is used and handling their requests (access, correction, deletion);
• protecting the computer where the app is installed (a system login password and disk encryption, such as BitLocker or FileVault);
• keeping backups in a safe place and not losing their password.

The app helps with this protection: backups are encrypted with your password, and passwords are kept in the operating system's credential store.

When you ask, the app sends the results by email through your own Gmail account. In that case, the message follows Google's rules.

2. Your license data

To sell and validate the license, we process:

• the name and email given at purchase;
• the license code, the plan and the payment status;
• a code for each computer where the license was activated (up to 2). This code is generated from a system identifier and does not reveal the computer's name or its contents.

We use this data to issue and renew the license, send the code by email and provide support, on the basis of performance of a contract (LGPD, art. 7, V). The app communicates with the license server to activate, renew and remove the license and, on Courtesy and Founder accounts, for Feedback and scale submission (section 3).

Emails. While your license is active, you may receive service notices (for example, changes to these terms or an important problem in the app), based on the performance of the contract. PounceFit news and offers only reach you if you tick "I want to receive PounceFit news by email" in the app Settings (LGPD, art. 7, I, consent). Every news email has a link to unsubscribe, and you can untick the box at any time.

Payment data (card, boleto, Pix) is processed by the payment provider Asaas (Asaas Gestão Financeira Instituição de Pagamento S.A.). We do not receive the card number.

3. Feedback and scale submission

On Courtesy and Founder accounts, messages from the Feedback tab, with the screenshot if you attach one, go to our server and to the support email. When you submit a new scale, and only after your consent, the app sends the data the scale transmits over Bluetooth, the weights you typed, the brand, the model and the optional photo. We do not send names or client data. The device's Bluetooth address is not sent and, when the system provides it, it is also removed from the advertisement data. This data is used only to add support for the model and is deleted 90 days after the analysis ends, or at most 180 days after submission; the technical description of the scale (the "recipe"), with no personal data, is kept.

4. First launch signal

The first time the app opens on a computer, it sends our server one anonymous signal, only once: a random code created on the spot (it does not come from the computer and is not the license code), the app version, the system (Windows, Mac or Linux) and the system language. The server also notes the country estimated from the connection. No name, email, license or client data is sent. We use this signal only to count how many installations become customers (legitimate interest, LGPD, art. 7, IX). Without internet, the app tries again on the next launches until it succeeds and then never sends it again.

5. Who helps us

• Cloudflare: hosts this website and the license server.
• Resend: sends PounceFit emails (license code, notices and, for those who opted in, news).
• Payment provider: Asaas.
• GitHub: hosts the app installers and updates.

Some of these services are located outside Brazil. The transfer follows art. 33 of the LGPD.

6. This website

The website does not use cookies, has no ads and does not load third-party fonts. We measure visits with Cloudflare Web Analytics, which uses no cookies and does not identify you: it counts page views, the referring site, the country, the device type and the browser. We also count clicks on some buttons (such as Download and Subscribe) and use of the calculators: our server keeps only the button name and the page language, added up by month, with no IP address or other data. The download page queries the GitHub API to find the latest version, and the pages query our server to show short notices at the top. Cloudflare's servers log technical access data (such as the IP address) for security.

7. "Notify me" sign-up

On the pricing page, people outside Brazil can leave their email to be notified when the app can be bought in their country. For this sign-up we store the email, the country you enter, the country estimated from your connection and the page language. We use this data only to notify you when sales open in your country and to measure interest in each country. It is kept until you ask to be removed from the list, or for up to 2 years. 8. How long we keep data

License data is kept while the license exists and, after that, for the period required by tax and civil law (5 years, the tax period). Scale submission data has its own period, described in section 3. Feedback tab messages, with the screenshot, are kept for up to 2 years.

9. Your rights

You can request access, correction, portability or deletion of your license data, including Feedback messages and scale captures, and information about who we share it with, by email at contato@pouncefit.com. Data protection officer: Leonardo Vinicius Neri Caraca, at the same email.

10. Changes

If this policy changes, the date at the top is updated. Significant changes are announced by email to customers.
